Please read these Terms of Service carefully before using InvoiceSorted. By using our service, you agree to be bound by these terms. If you do not agree, do not use the service.
Note: These terms are a reasonable conservative template. We recommend you obtain independent legal advice before relying on them, particularly for complex or high-value matters. InvoiceSorted is not a law firm and these terms do not constitute legal advice.
1. The service
InvoiceSorted provides a document-preparation and guidance service only. We are not a law firm, we are not regulated by the Solicitors Regulation Authority (SRA), we are not affiliated with any law firm, and we do not provide legal advice or legal representation.
We prepare documents and provide guidance based on the information you give us. We do not send or file anything on your behalf. You review, sign, send, and file your own documents. You remain solely responsible for the conduct of your claim and for any decisions you make about it.
If your matter is complex, high-value, or involves contested facts, we recommend you seek advice from a qualified solicitor before proceeding.
2. Eligibility
The service is available to UK businesses pursuing unpaid invoices through the England and Wales small claims track, for claims up to £10,000. By using the service, you confirm that:
(a) you are acting in the course of a business or trade;
(b) your claim is governed by English law and falls within England and Wales;
(c) the amount claimed does not exceed £10,000; and
(d) the information you provide to us is accurate, complete, and not misleading.
3. Fees and payment
Our fees are staged as follows and apply only if you choose to escalate:
Case check: free.
First chaser: free.
Letter Before Action: £7.
Issue the claim: £77.
Secure judgment: £90.
Court fees are charged separately by His Majesty's Courts and Tribunals Service (HMCTS). You pay court fees directly to HMCTS; they are not collected by InvoiceSorted. If your claim succeeds, the court can order the defendant to reimburse your court fee and any interest. InvoiceSorted's own fees are not normally recoverable on the small claims track, as that track does not ordinarily award legal costs to the winning party.
Prices shown are exclusive of VAT. If VAT applies, it will be added and shown before you pay.
4. Your responsibilities
You are responsible for:
(a) providing accurate and truthful information about your claim;
(b) reviewing each document we prepare before you send or file it;
(c) signing your own documents;
(d) sending documents to the other party and filing them with the court yourself;
(e) the conduct of your claim, including meeting any court deadlines; and
(f) complying with all applicable court rules and procedures.
5. No guarantee of outcome
We cannot and do not promise any particular result. The outcome of a claim depends on many factors outside our control, including the defendant's response, the evidence available, and the decision of the court. Past outcomes are not a guide to future results.
6. Acceptable use
You must not use the service for any unlawful purpose, to pursue a claim you know to be fraudulent or exaggerated, to harass or intimidate any person, or in any other way that is abusive, dishonest, or contrary to applicable law.
7. Intellectual property
Documents we prepare for you may be used by you for the purposes of your own claim. You may not resell, republish, or distribute them as templates or as products. Our brand, software, and site content remain the property of InvoiceSorted.
8. Limitation of liability
This service is provided to businesses, not consumers. To the extent permitted by law:
(a) we are not liable for any indirect or consequential loss, loss of profit, loss of revenue, or the outcome of any claim;
(b) our total aggregate liability to you for any claim arising out of or in connection with these terms or the service is limited to the fees you paid us for the specific matter to which the claim relates;
(c) nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud or for death or personal injury caused by our negligence.
9. Termination
You may stop using the service at any time. We may suspend or terminate your access if you breach these terms or if we have reasonable grounds to believe your use of the service is unlawful or harmful. Fees already paid for work already completed are non-refundable, except where required by law.
10. Changes to these terms
We may update these terms from time to time. We will post the updated version on this page with a new "Last updated" date. Continued use of the service after a change constitutes acceptance of the updated terms.
11. Governing law and jurisdiction
These terms are governed by the law of England and Wales. Any dispute arising from or in connection with these terms or the service is subject to the exclusive jurisdiction of the courts of England and Wales.
